1. About these terms

These terms apply to your use of caspian-opendata.com (the "website"). By using the website, you agree to them. If you don't agree, please don't use the website.

The website is operated by Caspian One Open Data Limited ("C1OD", "we", "us"), registered in England and Wales, company number 15814108, registered office 18 Christchurch Road, Bournemouth, BH1 3NE, United Kingdom.  These terms cover the website only. Access to the C1OD platform, APIs and services is governed by the separate agreement between C1OD and each client. If those agreements conflict with these terms, the agreements take priority.

2. Using our website

You may use the website to learn about C1OD and to contact us. When you use it, you must not:

  • Break any law or regulation, or infringe anyone's rights

  • Try to gain unauthorised access to the website, its servers or any connected system

  • Introduce viruses, malware or other harmful code, or carry out a denial-of-service attack

  • Scrape, copy or harvest content or data by automated means, except for normal search engine indexing

  • Use the website or our name to send spam or misleading communications

  • Submit false information, or information about someone else without their permission, through our forms

We may suspend or restrict access to the website, or any part of it, at any time. We do our best to keep it available and up to date, but we don't guarantee that it will be uninterrupted, error-free or free from viruses. You are responsible for your own device security.

3. Information only, not advice

Content on the website, including articles, insights, regulatory commentary and case studies, is general information about Open Data, Open Banking and our services. It is not legal, regulatory, financial, investment or technical advice, and you shouldn't rely on it as such. Take professional advice before acting on it.

Regulation in this area changes often. Our commentary reflects our understanding when it was published and may not be updated. We don't promise that any content is complete, accurate or current.

Nothing on the website is an offer to provide services. Any services are provided only under a signed agreement with C1OD. Product descriptions, timelines and features shown on the website may change.

References to regulators, standards bodies, financial institutions or other organisations don't mean they endorse C1OD, unless we say so.

4. Intellectual property and links

Our content. We, or our licensors, own all intellectual property in the website, including its text, graphics, diagrams, logos and design. The C1OD and Caspian One names and logos are our trade marks.

You may view, print and share pages from the website for your own business information, as long as you credit C1OD, link back to the source page and don't change the content. You need our written permission for any other use, including commercial reuse, or using our name or logos.

Linking to us. You may link to our website if you do so fairly and lawfully, and don't suggest any association, approval or endorsement from us that doesn't exist. You must not frame our website on another site.

Links to other sites. The website may link to third-party websites and resources, including regulators and other Caspian One group companies. We include these for convenience only. We have no control over them and aren't responsible for their content, availability or privacy practices.

5. Our liability

The website is provided free of charge, "as is" and "as available". It is intended for business users.

To the fullest extent the law allows, we aren't liable for any loss or damage arising from your use of, or reliance on, the website or its content. This includes loss of profit, revenue, business, data or goodwill, and any indirect or consequential loss, whether caused by negligence, breach of contract or otherwise.

Nothing in these terms limits or excludes liability that can't be limited or excluded by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Our liability for the platform and client services is set out only in the relevant client agreement.

6. Privacy, changes, governing law and contact

Privacy and cookies. Our Privacy Policy explains how we handle personal information you give us through the website, and our Cookie Policy explains how we use cookies.

Changes to these terms. We may update these terms from time to time. The date below shows when they last changed. Please check this page when you use the website, as the version in force at that time applies.

General. If any part of these terms is found to be unenforceable, the rest stays in effect. If we don't enforce a term straight away, we can still enforce it later.

Governing law. These terms, and any dispute arising from them or your use of the website, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
